1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and PowerLaunch ("Company", "we", "us", or "our") governing your access to and use of Pirate Trader ("the Game"), a browser-based Progressive Web App accessible at https://v0-pirate-trading-game.vercel.app.

By accessing or using the Game, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Game.

2. Eligibility

You must be at least 13 years of age to use the Game. If you are under 18, you represent that you have your parent or guardian's permission to use the Game. By using the Game, you represent and warrant that you meet these eligibility requirements.

3. Description of Service

Pirate Trader is an entertainment-focused trading simulation game set in a pirate-themed world. The Game may include features that allow you to connect a Solana-compatible cryptocurrency wallet to enable certain gameplay features.

The Game is provided for entertainment purposes only. It is NOT a financial product, investment platform, or trading service.

4. Wallet Connection and Blockchain Interactions

4.1 Wallet Responsibility

If you choose to connect a Solana wallet to the Game, you are solely responsible for:

  • The security of your wallet, private keys, and seed phrases
  • All transactions initiated from your wallet
  • Ensuring you are connecting to the legitimate Game URL
  • Understanding the risks associated with blockchain transactions

4.2 Irreversibility of Transactions

All blockchain transactions are final, irreversible, and publicly recorded on the Solana blockchain. We cannot reverse, cancel, or modify any transaction once it has been confirmed on the blockchain. You acknowledge and accept this risk.

4.3 No Custody

We do not have custody of your cryptocurrency, tokens, or digital assets. We do not have access to your private keys and cannot initiate transactions on your behalf without your explicit approval through your wallet.

5.1 Not Financial Advice

THE GAME IS FOR ENTERTAINMENT PURPOSES ONLY. NOTHING IN THE GAME CONSTITUTES FINANCIAL, INVESTMENT, LEGAL, OR TAX ADVICE. ANY IN-GAME TRADING, PRICES, OR ECONOMIC MECHANICS ARE SIMULATED AND DO NOT REFLECT REAL-WORLD MARKETS.

5.2 No Guarantees

We make no guarantees regarding the availability, functionality, or performance of the Game. The Game may be modified, suspended, or discontinued at any time without notice.

5.3 "As Is" Provision

THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, POWERLAUNCH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or data
  • Loss of cryptocurrency or digital assets
  • Unauthorized access to your wallet
  • Errors or omissions in the Game
  • Any conduct of third parties
  • Any other matter relating to the Game

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED ONE HUNDRED US DOLLARS ($100).

7. Prohibited Uses

You agree not to:

  • Use the Game for any illegal purpose
  • Attempt to exploit, hack, or manipulate the Game
  • Use bots, scripts, or automated systems
  • Reverse engineer, decompile, or disassemble the Game
  • Copy, modify, or distribute the Game or its assets without permission
  • Impersonate others or provide false information
  • Interfere with other users' enjoyment of the Game

8. Intellectual Property

All content, features, and functionality of the Game, including but not limited to text, graphics, logos, icons, images, audio, and software, are the exclusive property of PowerLaunch or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Game for personal, non-commercial purposes only.

9. Indemnification

You agree to indemnify, defend, and hold harmless PowerLaunch and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of your use of the Game, violation of these Terms, or infringement of any rights of another party.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Game shall be resolved exclusively in the courts located in Delaware.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last Updated" date at the top of this page. Your continued use of the Game after any changes constitutes acceptance of the new Terms.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
